TUPPERWARE'S PAY IT CHAIN OF CONFIDENCE CHALLENGE

How to Enter Tupperware's Chain of Confidence Challenge ("Contest"):
To enter, visit chainofconfidence.com ("Web Site"), beginning 9:00 a.m. ET on May 14, 2009 through 11:59 p.m. ET on August 14, 2009. There are two (2) ways to enter. You must register online only at the Web Site and provide all requested information and submit your entry as follows:
1. Submit an essay about how your friend or relative ("nominee") has inspired you in 1,500 characters or less. You may also submit with your entry, optional photograph(s) of your nominee only and/or an optional video depicting your entry. You may submit up to three (3) photographs and one (1) video. The entry must: 1) be complete to be eligible and must include an essay in 1,500 characters or less; 2) if submitting photographic image(s), it must be in color or black and white (jpeg or gif files) no larger than 500KB in file size representing your essay; 3) if submitting photographic image(s), it must be your property, must be non-professional and you may need a Release from your nominee depicted in photo(s) (at Sponsor's request), 4) if submitting photographic image(s) or a video, it must be uploaded in accordance with the specifications set forth at the Web Site. 5) if submitting a video it must be a maximum of 60 seconds, no larger than 10MB in size and must be in one of the following formats: .mpeg (.mpg4), .avi, .mov or .wmv. Limit one entry per person. Please note, you must notify your nominee to let him/her know you are entering on his/her behalf, so that he/she may provide approval of use of such photograph(s) or video (if photograph or video is submitted). By entering, you and your nominee agree to waive any rights you or your nominee may have to the photograph(s) or video submitted (if applicable).
2. As a Tupperware Consultant, submit an essay about how a fellow Tupperware Consultant, friend or relative ("consultant nominee") has inspired you in 1,500 characters or less. You may also submit with your entry, optional photograph(s) of your consultant nominee only and/or an optional video depicting your entry. You may submit up to three (3) photographs and one (1) video. The entry must: 1) be complete to be eligible and must include an essay in 1,500 characters or less; 2) if submitting photographic image(s), it must be in color or black and white (jpeg or gif files) no larger than 500KB in file size representing your essay; 3) if submitting photographic image(s), it must be your property, must be non-professional and you may need a Release from your nominee depicted in photo(s) (at Sponsor's request), 4) if submitting photographic image(s) or a video, it must be uploaded in accordance with the specifications set forth at the Web Site. 5) if submitting a video it must be a maximum of 60 seconds, no larger than 10MB in size and must be in one of the following formats: .mpeg (.mpg4), .avi, .mov or .wmv. General Entry Information: Entries must be received no later than 11:59 p.m. ET on August 14, 2009. Entrants, nominee or consultant nominee and winners acknowledge and agree that their entries become the sole property of the Sponsor, who thereby has the right to publish, display, edit, adapt, modify, reproduce, promote and otherwise use entries in any way it sees fit. Entries deemed lewd or inappropriate, in Sponsor's sole discretion will be disqualified. By entering, you understand that the Sponsor also has the exclusive right to use the entries and excerpts of the entries (essays, photographs and videos, if applicable) in any advertising and promotional materials (visual, sound, print and/or electronic form), including posting entries on its Web Site and non-affiliated web sites. Entrants may not copy or otherwise plagiarize the entry from any source. Any entry or portion thereof that is, in the Sponsor's sole discretion, obscene, profane, lewd, defamatory, contains any third party materials or proprietary property, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the entrant. Entrant represents and warrants that: i) all rights to the entry belong to him/her and the entry does not and shall not infringe on any copyright or any other third party right nor violate any applicable law or regulation, (ii) he/she has the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright and other related rights to the entry, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity, (iii) he/she hereby holds the Sponsor harmless from and against any third party claim arising from use of the entry and he/she waives any right to inspect or approve uses of the entry or to be compensated for any such uses. Therefore, clothing worn in the photo(s) should not contain any visible logos, drawings, cartoons, phrases, trademarks or other third-party materials.
By entering, you understand your entry, including photo and video may be posted online and will be subject to voting by members of the general public. Posting will not be immediate; there may be a short period of time between entry submissions and posting. Any video/photo(s) deemed inappropriate or unsuitable for posting, in Sponsor's sole discretion, will be disqualified and will not appear on the Voting Site. Entry material may be disqualified if the material or portion thereof, in the Sponsor's sole discretion does not meet the entry criteria outlined in these Official Rules, or contains one or more of the following:
Eligibility: This Contest is open to legal residents of the 50 United States and D.C. and Canada, who are of the age of majority in their state/province of residence as of date of entry. Employees of Tupperware Brands Corporation (not including Tupperware Consultants), DeVries Public Relations, their parent companies, subsidiaries, affiliates, advertising and promotion agencies and the immediate families and members of the households of each of the above are not eligible to enter. All federal, state, provincial, municipal and local laws and regulations apply. Governed by U.S. and Canadian laws. Void where prohibited by law.
Judging to Determine Two Grand Prize Winners: All eligible [with any video or photo(s)] entries received will be judged (essay only), to determine two (2) winners (one nominee and one consulting nominee) from among all eligible entries submitted. Judging will be conducted by a panel of judges, whose decisions are final on all matters relating to this Contest, based on the criteria listed below. Submissions that contain more than 1,500 characters or are considered inappropriate are not eligible. In the event of a tie, tied entrants will be re-judged based solely (100%) on the Most Inspirational, to determine the winner(s). All entries must be the sole, original work of the entrant and must not infringe on any third-party rights. Judges may disqualify previously published submissions or those that have won previous awards or competitions. No information regarding entries or judging, other than as otherwise set forth in the Official Rules, will be disclosed.
Judging criteria: Most Inspirational 40%; Most Unique 30%; and Relevance to Theme 30%.
Online Voting to Determine the Viewer's Choice Grand Prize Winner: All eligible entries will be posted at http://chainofconfidence.com/index.php?page=essay-list ("Voting Site"), beginning 9:00 a.m. ET on May 14, 2009 through 11:59 p.m. ET on August 14, 2009 and will be subject to voting by visitors to the Site. Visitors can only vote one time per person. Voters are encouraged to judge the entries based on the criteria listed above. One Grand Prize winner (nominee or consultant nominee) will be determined according to the entry that receives the highest number of visitor votes (50%) along with the highest average rating (50%). In the event of a tie vote, Sponsor will make the final determination of the Viewer's Choice Grand Prize winner.
Prizes and Approximate Retail Values ("ARV"): GRAND PRIZE (3: 2 Awarded to the winning contest nominees and consultant nominees depicted in winning entries and 1 awarded to the Viewer's Choice Winner): USD$5,000, awarded to the charity of nominee's/consultant nominee's choosing. Nominee/consultant nominee can choose a charity of his/her choice, subject to Tupperware's approval, or a charity chosen from a list provided by Tupperware and a Tupperware gift card valued at USD$1,000. (ARV: USD$6,000 each). Consultant nominee will also receive an official Chain of Confidence award at the Chairman's Summit in January 2010. CORRESPONDING ENTRANT/NOMINATOR PRIZE (3): The corresponding entrant that submitted a Grand Prize winning entry will also receive a Tupperware gift card valued at USD$1,000. (ARV USD$1,000 each). Grand Prize winners will be notified by mail/phone at the address and/or phone number used at the time of entry. The Contest is expressly contingent upon a sufficient number of eligible entries being received by the Sponsor. Prizes are not transferable; no substitutions or cash equivalents are allowed. Sponsor assumes no responsibility or liability, for damages, losses or injury resulting from acceptance or use of any prize. Taxes related to the prizes, if applicable, are the sole responsibility of the individual winners.
General Rules: Unless otherwise prohibited by law, submission of entries constitutes permission to use the entrant's name, entry submission {including essay, photo(s) and video, if applicable}, likeness and biographical information for advertising and publicity purposes, without further compensation. Potential Grand Prize winners and the corresponding entrants that submitted the Grand Prize winning entries will be required to sign and return an Affidavit of Eligibility, Liability Release, Assignment of Rights and where legal, a Publicity Release within ten (10) days of notification attempt or prize will be forfeited and an alternate will be determined. Return of any prize or prize notification as undeliverable may result in disqualification and alternate determination. All entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, on line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest, Web Site or Voting Site; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor and its agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to participate or by any human error which may occur in the processing of the submissions in this Contest. Sponsor reserves the right to cancel the Contest if it becomes technically corrupted, and award the prizes from the eligible entries received prior to cancellation. Entrants agree to be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding. Any litigation respecting the conduct or organization regarding a publicity contest in Canada may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
Jurisdiction: The Contest shall be governed by and interpreted in accordance with the laws of the State of Florida in the U.S. applicable to promotions fully carried out within Florida, USA. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and under no circumstances will nominator/nominee be permitted to obtain awards for and nominator/nominee hereby waives all rights to claim punitive, incidental and consequential damages and any other damages (including attorneys fees), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Each nominator/nominee acknowledges that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce the nominator/nominee to execute any document and nominator/nominee acknowledge that they have not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by the Sponsor of any term of any document in a particular instance shall not be a waiver of such term for the future. Each nominator/nominee agrees that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.
